Working and Skilled Visas

Employer Sponsored Workers – Subclass 482

The subclass 482 visa is for overseas skilled workers who have been sponsored and nominated by an Australian employer to work in Australia on a temporary basis.  

You must:

  • be nominated for a skilled position by an approved sponsor

  • have the right skills to do the job

  • meet the relevant English language requirements

 

The visa applicant must have a minimum of have at least 2 years relevant work experience in your nominated occupation or a related field prior to submitting the application.

The skilled position must be one of those listed in the Short -term skilled occupation list or ​Medium and Long-term Strategic Skills List (MLTSSL) or the Regional Occupation List (ROL). There are three stages to employing a skilled worker under the subclass 482 visa program:​

  • employer applies to be a sponsor - ( Sponsorship)

  • employer nominates a position     - ( Nomination)

  • employee applies for a visa            - ( Visa )

Applications for each of these three stages may be submitted at the same time.

Skilled Independent Visa - Subclass 189 

This visa is for invited workers and New Zealand citizens with skills required in Australia to live and work permanently anywhere in Australia..

There are two streams.

1.       Points Tested Stream

2.       New Zealand Stream

 

Points Tested Stream

You must;

  • have an occupation on the relevant skilled occupation list;

  • have a suitable skills assessment for the occupation;

  • meet the minimum English requirements;

  • meet the age, health and character requirements;

  • satisfy the points test; and

  • be invited to apply for this visa; 

 

The process to apply for a subclass 189 visa is to lodge an Expression of Interest (EOI) through Skill Select to let the DOHA know you want to apply for this visa. You will also need to  achieve the pass mark set for the skilled migration points test – currently set at 65 for these visas.

Upon invitation lodge your application within 60 days.

You must be below 45 years of age when you are invited to apply for the visa.

 

New Zealand Stream

You must

  • hold a New Zealand Special Category (subclass 444) visa;

  • have usually resided in Australia for at least the last 5 years;

  • have started living here on or before 19 February 2016;

  • in most cases, have a taxable income at or above a specific income threshold for each of the required income years prior to lodging an application

With this visa you can;

  • stay in Australia indefinitely;

  • work and study in Australia;

  • enrol in Australia's public health care scheme, Medicare;

  • sponsor your relatives to come to Australia;

  • travel to and from Australia for 5 years; and

  • if eligible, become an Australian citizen

Skilled Regional (Provisional) Visa Subclass 491

This is a visa for skilled people nominated by a state or territory government to live and work in regional Australia.

You must:

  • be nominated to apply by a state or territory government agency, or an eligible relative must sponsor you;

  • have an occupation on a relevant skilled occupation list;

  • have a suitable skills assessment for the occupation;

  • be invited to apply; and

  • satisfy the points test

This is a provisional visa. It is for skilled workers who want to live and work in regional Australia. It allows you to;

  • ​​​​​​​​​​​stay in Australia for 5 years;

  • live, work and study in a designated regional area of Australia;

  • travel to and from Australia as many times as you want, while the visa is valid​; and 

  • apply for permanent residence after 3 years from the time your visa is granted.​

 

The process and requirements are almost similar to Skilled Independent visa (subclass 189) with an additional requirement that you will need to be nominated by a State or Territory as a suitable candidate for an occupation listed on their relevant skilled list.

Global talent visa (GTI) (Subclass 858)  

  • This is a permanent visa for people who have an internationally recognised record of exceptional and outstanding achievement in an eligible field. Before you apply for this visa, you need an eligible person or organisation to nominate you.

  • The aim of this program is to attract highly skilled candidate who can demonstrate international recognition and achievements in the target industries to live in Australia permanently.

  • Through the Global Talent Visa, Australia is seeking highly skilled and talented people from across the globe in the following industries for priority processing so that they may settle in Australia.

The target sectors are as follows:

  •      Resources

  •      Agri-food and AgTech

  •      Energy

  •      Health Industries

  •      Defence, Advanced Manufacturing and Space

  •      Circular Economy

  •      DigiTech

  •      Infrastructure and Tourism

  •      Financial Services and FinTech

  •      Education

Eligibility to apply for this visa:

  • have an internationally recognised record of exceptional and outstanding achievements;

  • are prominent in your field of expertise;

  • would be an asset to the Australian community;

  • would have no difficulty in obtaining employment, or becoming established independently, in Australia in your area of talent;

  • have an organisation or individual in Australia with a national reputation in the same field, who can attest to your record of achievement;

  • have a current or potential income of AUD $153,600;

  • meet onshore qualifying visa requirements including Schedule 3 (if applicable);        and

  • make your application in relation to one of the target sectors set out above or a related sector.

Employer Nomination Scheme

– Subclass 186

The Employer Nomination Scheme visa (subclass186) lets skilled workers, who are nominated by their employer, live and work in Australia permanently. The skilled workers may be onshore or offshore. 

There are three streams in this scheme:

1.       Direct Entry Stream

2.       Labour Agreement Stream

3.       Temporary Residence Transition stream

Basic eligibility to apply for this visa, you must:

  • be nominated by an approved employer for an occupation on the relevant list of eligible occupations; 

  • meet the required skills, qualifications and relevant work experience; and  

  • meet English language, health and character requirements.

There are exemptions  available relating to age, skills and English language ability. These depend on your nominated occupation, salary and past work experience.

Skilled Nominated visa (Subclass190)

  • This visa lets nominated skilled workers live and work in Australia as permanent residents.

  • The process and requirements are almost similar to Skilled Independent visa (subclass 189) with an additional requirement that you will need to be nominated by a State or Territory as a suitable candidate for an occupation listed on their relevant skilled list.

Skilled Employer Sponsored Regional (Provisional) Visa -Subclass 494

Skilled Employer Sponsored Regional (Provisional) visa (Subclass 494) (‘SESR’) visa is for skilled workers who want to work in designated regional areas of Australia to fulfill skills shortages and where employers can't source an appropriately skilled Australian worker. It is possible to qualify for this scheme with at least three years prior work experience and a positive skill assessment in the nominated position.

There are two streams in this scheme.

1.       Direct Entry Stream

2.       Labour Agreement Stream

Basic eligibility to apply for this visa, you must:

  • be nominated by an approved employer for an occupation on the relevant list of eligible occupations; 

  • meet the required skills, qualifications and relevant work experience;

  • be under 45 years of age;   

  • meet English language, health and character requirements.

For this type of visa, the application will normally be supported by a successful application with the relevant Regional Certifying Body (‘RCB’) of the designated regional area. The RCB’s role is to assess the Annual Market Salary Rate (AMSR) for the nominated position in the SESR nomination application and provide advice to the Department of Home Affairs (‘DOHA’). Requirements for a successful RCB application varies according to the regions and can be complex.
